Military Vaccine Exemptions for Children

(05/22/2017) I know there have been a lot of requests to join the ‘Secret’ Facebook groups. However, there is a reason they are secret. Those who choose to no longer vaccinate come under fire a lot and the groups that I am in were all simply ‘Closed’ at one point or another. All had to change to ‘Secret’ to keep out those with less-than-good-intentions. Unfortunately, this means that the ONLY way to add people is to friend them on Facebook first. I am not comfortable doing this. 

HOWEVER, I was given the name of a ‘Closed’ group as a recommendation for those looking for a place on Facebook to start. My suggestion would be to Join this group, hang out for a while and post. It could be an excellent way to show that you’re ‘safe’ and get added to some of the other groups.

I know this sounds harsh, but, unfortunately with vaccine choice under fire, it’s the way things kind of need to be at the moment to protect ourselves and our children.

Last year with hubby deploying I wanted to be able to use the Child Development Center’s drop in service for appointments and their Give Parents a Break ‘date nights’. With my children not up to date on their vaccinations according to regulations, I needed to get their exemptions in line. Although we live in Utah and Utah has all three exemptions (medical, religious, and philosophical), the military only accepts medical and religious (I was told initially that they would ONLY accept medical, but knowing that wasn’t true, I researched further on what I would need).

Although the question doesn’t come up very often, it does come up. It’s not too hard to explain, just involves a lot of forms (thankyoumilitary) so I thought I’d just write a post I can refer people to.

The section pertaining to the CDC, FCC and other base activities is on page 12, section 3-5b:

(b) Children attending DOD and USCG-sponsored primary and secondary schools, childcare centers, or similar facilites are required to be up to date on all age appropriate ACIP-recommended vaccines for children unless there is a documentation of previous immunization, religious exemption, or medical contraindication. For foreign-national children outside of the United States, observe host country recommendations or requirements.

What I did for my process is started with DoDEA Form 2943. I filled it out, and in the ‘reason’ section (section 4) I wrote:

After turning in the form with page 12 & 13 from the regulations, with the religious exemption part highlighted, they requested a letter from clergy. According to what I know, a letter from clergy is NOT required for civilians, only for active duty, but I complied with the request. While I was working on getting that letter, I sent them the following:

To Whom It May Concern:

I understand that you have requested a letter from my clergy regarding my religious reasons for not vaccinating my children for their exemption forms for the CDC and FCC offices here at Hill Air Force Base.

I wanted to update you and let you know that although it is my understanding that clergy / chaplain letters are ONLY required for those who are ACTIVE DUTY and requesting exemption (NOT their dependents), I am in the process of acquiring the requested letter. My leader is in contact with the local higher-ups to confirm what the official stance is.

However, I’d like to remind you of the following, found in the 2006 edition of the Code of Federal Regulations, Title 29, part 1605 (enclosed) which states:

“The fact that no religious group espouses such beliefs or the fact that the religious group to which the individual professes to belong may not accept such belief will not determine whether the belief is a religious belief…”

So, should it come back that the local heads of my church have no official stance that backs my religious beliefs, that does not negate them.

If you have any further questions or concerns, please feel free to contact me directly.

I felt it was important to remind them that should it turn out that there is no official stance my church leaders can take (which was the case) that that did NOT negate my beliefs. In my case, I was fortunate in that one of the base chaplains that we had been in contact with was willing to write a letter to the effect that he had talked with us and believed that our beliefs that our children should not be vaccinated were sincere.

The letter and all the forms or whatever they fill out went up the chain of command and we eventually got a response back that our exemptions were processed.

Now. Does this mean all is peaches and roses? No. The CDC has the right (which they have exercised) to refuse my children admittance in the case of an ‘outbreak’. The one time I was ready to drop them off for Give Parents a Break, there had been a case of chicken pox. It didn’t matter that I didn’t feel it was an issue, they were still allowed to / required to not admit my children since they had not been vaccinated for chicken pox.

UPDATE: AUGUST 2015

It’s been a few years since I wrote this and our situation as changed a bit with both kids being school age now and with having moved overseas (which was NO issue at all, the questions of vaccines didn’t even really come up).

I just wanted to quickly say that so far our experience with registering the kids for school has been a piece of cake. For an on base DoDEA school overseas in Japan, all I had to do was fill out the DoDEA form (http://www.dodea.edu/StudentServices/upload/2011_2942_0_M_F4.pdf) and wrote “We do not vaccinate for religious reasons” in section 4.

That’s it. School nurse didn’t bat an eyelash, just said ‘thank you’.

We’ve done this three times now with no issue at all. In fact, I wound up having a nice short conversation the last time and it basically came down that the nurse agreed that parents had the right to refuse and that was okay. 🙂

I have not yet attempted to register them with the CDC here for either Give Parents a Break or for the School Age program as it simply hasn’t come up yet. If I do, I will update this again to reflect my experience.

      1. I don’t have an answer for you other than the standard that Germany *requires* NO vaccines for tourists, therefor NONE should be required for PCSing family members according to the military UNIVERSAL regulations. I’m hoping someone else might have more Germany – specific information.

    1. But that’s kind of the whole point of this. They may try to deny, but the regulation says that you can file a religious exemption. It’s like the whole “No Shots, No School” which isn’t true :-/

  3. Thank you soooooo much for sharing this. I’d like to share my recent experience at Schofield Barracks in Hawaii. My spirit has been crushed. I was told 4 separate times by 4 separate people at the Parent Central Services at Schofield that Kai was allowed to register for child care services as long as I wrote a memo for a vaccination exemption using either personal, medical or religious reasons. They told me that I did not require a letter from clergy or medical professional to request this exemption. I went through the WHOLE process of registering on online, in person and went to my pediatrician to fill out all the forms they required. After all that, I got a phone call informing me that Kai is actually not allowed to go to hourly care or preschool (he’s 2). They will however allow him to join the other programs (music, sports etc.). I was told that the program director is calling the shots (no pun intended) on what programs she deems acceptable for non vaxed children. HELP!!! Do I still have a case or am I SOL?     1. I don’t have any experience with that post, or with the Army really as we’re Air Force. I will say that in my experience, registering my kids at school on base/post (they’re 6 and 7 now) has been a piece of cake. Just the DoDEA form with a simple “We do not vaccinate for religious reasons” and that was it. The cited regulation applies to DoDEA schools as well as daycare centers.

  5. Thank you so much for this article. We are currently working on the command sponsorship in order for us to go to S. Korea with my husband and I was worried I’d encounter some trouble. We did have trouble in Ft. Bliss to get the kids on the CDC but my daughter went to school on post without a hassle when I showed her exemption. Now in Korea both my kids will attend school and we will be TTC there, so I keep getting as much info as I can. Thanks again!!

    1. Sorry, I don’t have any Korea-specific information. All I can say is that there are no entry vaccinations required for S. Korea (http://wwwnc.cdc.gov/travel/destinations/clinician/children.extended_student/south-korea note that all say RECOMMENDED not REQUIRED) so according to the regulations, there shouldn’t be an issue, just as there wasn’t for us to come to Japan. That being said… lol.

      Basically, if they follow the regulations, any place a family can be command sponsored, there shouldn’t be an issue as the regulations state that family members have to have REQUIRED (*not* recommended) vaccines to go. No country that families go to have required vaccines for entry. But we all know they try to not follow the regulations some times :-/

      1. A bit of an update 2 years later… I didn’t have any issues getting command sponsored to come to Korea, we’ve been here for almost 2 years and now I’m enrolling my son in kindergarten. Last year I used form 2942 and had no issues to enroll my daughter so I’m expecting the same outcome this time around.

    1. We PCSd to Misawa 2 1/2 years ago with no problems. The only time vaccines even came up for us was during the physical, and when I told the kids’ pediatrician that we don’t vaccinate for religious reasons, he just said “okay”. The reaction IN Misawa from doctors has been pretty much the same – both at the peditrician’s office for sports physicals, and even at the UCC.

      I have heard some people have had issues with PCSing to Okinawa though.

      1. My husband is AF and looking at taking a job in Okinawa. Do you happen to know what types of problems they had with getting a religious exemption? Should I try to contact the school directly? Thank you!

      2. I haven’t really heard much about the schools in Okinawa, it’s been that people have had push back about PCSing to Okinawa in general.

        The schools are DoDEA schools and so *should* follow the same exemptions. If they try to say they don’t accept them I would (nicely) ask what regulation they’re following since the regulation you’re aware of says that exemptions are allowed, and you know people who have had their children at DoDEA schools in Misawa under a religious exemption.

        I would say the same about PCSing. i.e., the regulations don’t prohibit it and people have PCSd to Misawa with no issues.

We are in VA, and The CDC took several weeks to review and approve what they said was a first time request to allow a child not fully vaccinated (I do not vaccinate my children for varicella or Hep B). They only allowed my children to attend if they were not in the same room with other children who have not had a varicella shot. The reasoning was that my unvaccinated children could spread varicella to the infant groups they share a room with (Hourly care is a combined group of 6 weeks to 5 years old). They did make accomodations for me by allowing me to have hourly care in a normally full time toddler room because it turned out that there is never a day an infant isn’t in the combined hourly care room. It’s been a huge headache, but where we live I have no other options but the CDC for my two year old. I am glad they did accommodate me, but it wasn’t an easy or short process, by any means. It took several weeks to process my form and arrange all of this.

  9. Oh thank you sooo much for this information!!! We are currently in Okinawa… had an awful time getting here with medical and our daughter not being vaccinated. They finally said my husband had to come with or without us for a two year tour. After tears and prayer we did the MINIMAL first round of immunizations to keep our family together. Now I have recieved a letter from her DoD school saying she will not be able to attend school without her vaccinations being up to date. We have kept our ground and beliefs intact through almost 25 years of public and private school. We even had to hire an attorney when we lived in New York when there were “suspected” cases of whooping cough and our unvaccinated son was sent home from school. This information is a true answer to prayer! Thank you again!

    1. Hi we are supposed to be deploying to Okinawa in August. Just wondering if u were forced to vaccinate fully or were u able to continue schooling ur kids without their full vaccines? Both of my daughters are unvaccinated

      1. We went to Misawa and had no problems. Another acquaintance also just PCSd to Misawa, but she homeschools.

        It was really simple for me. I just filled out the form (http://www.dodea.edu/StudentServices/upload/2011_2942_0_M_F4.pdf) and wrote on it, word for word, “We do not vaccinate for religious reasons.” That’s all there was to it. Nurse just said “thank you” and that was it!

        I have heard of people having more issues with getting to Okinawa, but, really, it should be the same across the board, so I’m not sure why.

In the process of PCSING to Rota, I’m so frustrated they are giving me a hard time and actually denied our first screening package because my little guy is behind (I didn’t want to vax at all but my husband forced my hand with these orders, so even after vax in our 2yo and getting our infant his first round we were denied because my 7mo hasn’t had all his shots for his age, even though we have to wait 6 weeks after the first round to go. I wish I had of found this sooner.hoping I can avoid any further vaxs

  11. Please help! This blog has given me some hope! We are in the process of preparing for our PCS to Okinawa and we have also been told that both children need to be up to date on vaccines or my husband will have to go alone for 2 years (or be discharged). My 3yo is partially vaccinated, but my 18mo is a home birth baby and hasn’t had a single one. I’m in tears thinking of vaccinating him with everything he “needs” in the short amount of time we have (PCS date is early August 2016). If anyone has any advice or help, please let me know! I’m so worried and praying hard. Splitting up our family is not an option but I’m not sure what to do!

    1. Sorry, Kelli, I’m just now seeing this. I have heard of people having more issues with Okinawa. All I can tell you is that PCSing to mainland Japan is still easy :-/

    1. I’m not sure on that. You could either try or submit it as if you don’t vaccinate at all. For instance, my kids are partially vaccinated as we vaccinated then learned more and stopped. I submitted it as stated, that we don’t vaccinate for religious reasons, since that is now true.

      We are no longer in Misawa. We just PCSd back stateside!

My husband is in the Air Force and the CDC is basically forcing me to give my child the flu vaccine. They tell me there are no other exemptions. I feel backed into a corner, but I knew that there must be something that I can do. My children didn’t sign up to be in the military, so why should they be forced to be given something that they don’t need. Please if you have any updates, share. Thank you!

  15. Not sure if you’re still active on this, but I have a few questions. My husband recently passed away, he was active duty, USMC. My son has only had one set of shots when he was like 3 or 4 months and I have been really against them. I had a few questions since you went through it, that I would be greatly appreciative you could help me with!

      1. So my husband passed away in February. And I have to go back to work. I don’t agree with vaccinating our son and can still utilize base. Is there anything I need to look for? I’m located in Jacksonville FL.

        Do I have to have a letter? I just don’t know how it all works!

      2. Other than what I wrote about my experience with the CDC on base, I don’t really have anything else to tell you. My number one suggestion is to go in thinking it won’t be an issue. Just go in with the form. If they question it, have the regulation on hand. If they still question it, ask them to show you their regulation stating that they don’t accept waivers.

      3. Actually Stacy I was supposed to go to Jacksonville.. It is pretty easy there. U have to go to the county health center and ask the nurse for the exemption. They may tell u a few “facts” on vaccines but will hand u a religious exemption slip u sign.. That’s it. Do u know where u will be living in Jacksonville?

    1. The group is still there, it’s just set to secret. Most are jut due to the chance of getting the wrong type of people in there. Unfortunately I don’t currently know of any that aren’t set to secret, but I’ll keep looking!

I went against my own feelings and beliefs and less than a week ago started my youngest with her first vaccination, as I was told there was no way that CYSS (Army) would allow my children to attend without up to date shots. With my husband being deployed and family far away, I really need the hourly care to be able to keep my sanity.   20. what a great resource!!! currently stationed in Okinawa and we were told there were NO exemptions for here… hubby would have to be here for two years without us… we felt like we were forced into deciding between the lesser of two evils… the process to be able to move overseas is so overwhelming! the physical and emotional stress was more than we were able to juggle…so we did the first round of shots for our 6 year old… havent completed them and do not intend to. just got an update from the school about their vax requirements and flu shot schedule… this is such a sad and sore subject for us… our son is 25 and we did not vaccinate him… we are committed to this decision to the point of hiring an attorney on one occassion when he was in grade school… i guess my point is its ok to feel overwhelmed… the military can make you feel powerless as a parent… and if you decide you have to vax you are not a bad parent because of it! the stress this puts on a family is just so wrong!

  21. Hi! So glad I found this! Both my girls have been vaccinated up until recently. I have MTHFR genetic mutations, my oldest does as well, and my youngest has yet to be tested. Unfortunately MTHFR is still not completely understood or accepted and I’m very doubtful I’ll be able to use the medical side of the exemption.

    I called the CDC where my youngest is enrolled and was told by the person who answered that they had not seen an exemption approved in the 20 years they have worked there. Furthermore, I was told the only time they had seen a response to the waiver was one and a half years after it was submitted and that response was a denial.

    The state I reside in made the exemption very painless for my oldest based on personal reasons, but now I am faced with the process of getting a waiver for my youngest.

    My question is, did you simply submit to the CDC your DoDEA FORM 2942 along with the immunization records for what your child(ren) had already received? Was it given directly to the CDC or did you submit it to the Immunizations office in the clinic?

    My biggest fear is that we will be challenged on this since we have vaccinated up until now. I do not attend church, but I do believe in God and I do believe as parents we do and want the best for our children. We make decisions in their best interests based upon the information we have at the time. I don’t suppose there is a clear question there, I suppose I’m looking for words of encouragement. I’m very nervous about this.

    Unfortunately my husband and I have fears set on opposite sides. He fears our children becoming ill from not being vaccinated and I fear them becoming ill by being further vaccinated. Our oldest has a number of health issues (autism, asthma, add, and allergies) and our youngest has a speech delay (apraxia of speech it appears, although we are pending official input). I saw our youngest regress with her speech and the trouble she has now. I feel like all the challenges so far have been red flags and to me it is the universe saying “no more, stop before it’s too late.” It’s difficult because we both want what’s best for our kids, we just have different perspectives on what that looks like.

      As for the submission process, I submitted it to the FCC (Family Child Care) office as I had had better luck dealing with them. I am not sure what process it went through from there as I was not involved or informed of that. I also don’t remember exactly how long it took, but it wasn’t more than a few months maximum. They simply called me when the approval came it from the Pentagon. I then took a copy of the approval letter to the CDC and gave it to them. I believe I may have called them once or twice wanting to know where in the process it was and they nicely let me know (i.e., that it was at the base medical commander’s office, that it had left that office, etc.).

      In the process I DID NOT give them anything with the children’s previous vaccines (DS had been vaccinated through his 15 month vaccinations, DD had been through her 3 month (I guess they’re the 2 month set now?)). IMO, it didn’t matter that they had been given vaccines at one point, my knowledge about vaccines had changed and therefor, backed by my religious convictions, my stance had changed. To me it is no different than giving a child Amoxicillin and later discovering that they are allergic. Yes, they were given it at one point, now they no longer are.

      As for them not seeing an exemption approved in their 20 years, I wouldn’t worry about it too much. I’m guessing they also haven’t seen that many exemption requests. For example, I think that at the school the kids are at now they are 2 of only maybe half a dozen kids in the whole school that have exemptions. At school registration when I told the nurse that they had exemptions she pulled up the folder, exemptions are in the front pocket, and I only saw a few other forms in that pocket (no, I didn’t see any names, so no HIPPA violation there).

Once you know the history, exactly how they work, and the modern methods of nutrition and sanitation that have largely been responsible for much of the fear of such sickness, than you won’t be afraid anymore❤️

  22. Hi! We are Air Force and I’m wondering if you’ve ever found a way for the Active Duty member to be exempt from their vaccines? My husband’s tried every year to avoid them and then he nearly gets in trouble and has to go in. There has to be a way for him not to?

    1. The regulations state that medical and religious exemptions ARE allowed, but it does seem to be much harder to get them. It can also render the AD member undeployable and not eligible for reenlistment.

  23. Thank you for sharing what you’ve learned on your journey. I used the forms and references today and was looked at like I was crazy by a woman who has been working in the CDC for 26 yrs. She’d never experienced “this”. There are some additional local requirements in order to have my children attend the CDC but I’m ok with that. At the very least I hope this woman is curious enough to do her own research and get educated on the topic. Even if she doesn’t agree. Thanks again!

    From now on, I recommend using these PDF archive sites to upload any PDF files, and make multiple uploads. Check frequently to be sure they are still there. For information in website pages, save multiple copies to Archive.is, or something similar. They don’t want people having this information, even if it’s within their rights to claim a religious exemption to vaccines. If vaccines are so wonderful, why do they make finding exemption information so difficult? *rolls eyes*

I understand the procedure to get religious exemption for the CDC but was wondering if you have any idea on how to get the religious exemption for the medical exam to PCS overseas (Korea) because I’m told that unless I and my 3 year old are up to date on vaccines we won’t get the sponsorship. We just got our orders and it our first move overseas so I’m absolutely clueless and overwhelmed. I have an appointment scheduled in couple days and not sure what forms to bring or if I just mention to the doctor that I refuse to vaccinate based on religious beliefs.

  27. Hi — I am a Navy spouse looking for advice. I’ve read and highlighted BUMEDINST 6230.15A and BUMEDINST 1300.2B. We have religious exemptions in our home state. From what I can tell, there aren’t specific regulations that prevent unvaccinated dependents from an overseas PCS — it’s mostly up to the command + host country regulations? Is that true? But, I’ve heard horror stories from similar families having to take unaccompanied orders. I’ve also heard that it wasn’t an issue for some — why the discrepancy?

    If my husband receives any orders overseas it will most likely be to Japan. We homeschool, so childcare/school won’t be an issue for us.

    What should I start doing NOW to set us up for a successful PCS if we were to receive those orders?

    1. Navy seems to be harder for some reason, even though they follow the same document for regulations. I will tell you that there are NO vaccines REQUIRED for entry into Japan. In fact, there are very few countries in the world that require any vaccinations for entry. The few exceptions are countries where even then the only vaccine required for entry is for Yellow Fever. Others are just recommendations.

      As to the discrepancy… I don’t know. You would think that everyone would follow the same rules as it’s an official regulation. If they say you must be vaccinated, I would ask for the REGULATION (nicely) as you have a copy of the regulations that you are aware of and it doesn’t preclude you from PCSing overseas.

  28. My due date is about 6 weeks before my husband’s orders to Okinawa. I do not want to vaccinate and was told the country will not accept the child without it. It seems silly since the vaccinations are CDC “recommended” not required, but anyway. I need help on how to fight this. Do I contact someone in Japan? I don’t want to separate our family but hurting our baby with these damaging vaccines is a terrible choice. What resources do I have?

    1. What branch? If Air Force, people aren’t having troubles getting to Okinawa with no vaccines. Navy and Marines are having issues, although they technically follow the same regulations.

  29. I have read over all your posts but I still want to make sure that all I need is these letters for PCSing overseas. My husband is in the AF and we are going to Okinawa Japan. The base here in Montana is giving us quite a hard time. We had to talk to the base Chaplin and they want a letter or prof that we don’t give vaccines according to our religious beliefs. Also the health department is saying that in accordance with the CDC regulations we have to give our children all vaccines. Every AFI rule and CDC does not say that they are mandatory. Our temple is willing to sign a letter for us but I don’t know how to write it up. If you could please help me I would be so grateful. Thank you so much

    1. As for PCSing, I’m not much help on needing a letter as we didn’t come across that when PCSing to Misawa, Japan. Who is requesting the letter, the chaplain? If it’s not the chaplain, would the chaplain be willing to write something up since you already talked to them?

      I guess for a letter for your temple to sign off on I’d go with something like what I wrote above:

      “To whom it may concern;
      (We / I) {First and Last name(s)}, as the {(parent (s) / guardian(s)} of ______________________(name of child/children) are exercising (our/my) rights under the US Constitution, Army Regulation 40-562, BUMEDINST 6230.15A, AF JI 48-110, CG COMDTINST M6230.4F , section 3.2, para4, and Army Regulation 608-10, section 4-6, para 2, to receive Religious Exemption from Vaccination, due to our genuine and sincere religious beliefs which are contrary to the practices herein required.”

      Or you could try the simpler:

      “We do not vaccinate due to sincerely held religious beliefs.”

      I’m not sure why they are bringing up the CDC requirements during a PCS hearing as there’s no guarantee you’ll use the CDC once you PCS.

      Again, sorry if I’m not much help, but we just didn’t receive much push-back when it came to our PCSing overseas.

  30. We just found out that we will be PCSing to Ramstein Germany with the AF. My 8 year old son and 5 year old daughter are not vaccinated. We have had no problems getting religious exemptions in the non-DOD schools they have attended stateside. Has anyone here been assigned to Germany and did you have any problems entering Germany or enrolling in the DODEA school?

You’re helping so many that feel lost and overwhelmed, like myself. My husband is Navy and were currently living overseas in Bahrain. Do you know anything specific to this region for the Navy? We use the CDC for our almost 2 year old, but am nervous that I won’t be able to any longer. Also, for the health screen to LEAVE will they require vaccines? Never even done overseas before this tour (only 3 years service). We head to California next (in 6 months), which will be a battle in itself. 😦 I appreciate any further knowledge you may have and again, thank you for this resource!

    1. The only thing I can tell you about Navy and Bahrain is that the regulation cited is for ALL military branches, although I know some branches give more push-back than others and that some locations give more push-back than others.

      For example, I’ve heard about people having no issue PCSing to Misawa, Japan without vaccines but have had troubles with Okinawa, Japan. I’ve heard of people in the Air Force having no issues getting to Misawa (us) but having issues with the Navy to Misawa. It’s frustrating since the regulation should be applied to all branches and all locations, but that isn’t what happens sometimes.

      As for getting back stateside, there should be nothing that would prevent you getting back stateside.

I am home with my youngest (1 year old) now, but eventually he will start school, and knowing that there are people out there who have successfully navigated this system is reassuring. I’m in a slightly different situation though. I transitioned off of active duty to the reserves a year ago and haven’t had a physical since. While I was active duty I didn’t know there was a vaccine waiver, but now that I know, I’m planning to apply for it. Any insight you have into that process would be amazingly helpful!

I’ve been wracking my brain trying to figure out how to get a religious exemption to actually be accepted. *I’m SO scared of hearing “no” and being denied, but I’m really trying to put my faith in God that if my 3 yr old is meant to be in the ASYMCA PreK then it’ll work out*

      DoDEA site is down right now, but I think you’re talking about where it would usually have the date the form was created. As they’re still updating with the new form that date isn’t on there yet. Just ignore it.

      That is an excellent question. IMO, you could probably just leave that off. It would keep them from denying just because you referenced an Army regulation. I’ll try to update the post with that advice later. So it would just read

      That is the link for the multi-branch regulation. The first one referenced in #3 (Army Regulation 40-562, BUMEDINST 6230.15A, AF JI 48-110, CG COMDTINST M6230.4F). You may want to print off the page with section 3.2 to have as back up if they give you a hard time about using a religious exemption.

  36. My husband is slated for embassy duty next year for the Marine Corps. We do not know where we will go until he finishes the school in Sept 2018. I am due with our son in January and I’m terrified that in order for us to be put on his orders, we will have to be vaxxed. Is there a way around it? I’ve asked the Embassy Duty life page and everyone on there says there’s no way out of it because of other countries requirements. But I’ve heard of military families overseas with exemptions. Please help…I’m terrified and it’s keeping me up at night.

    1. So, here’s the deal. The only vaccines that should be *required* for you are to those countries that actually have *requirements* for tourist entry and those are a very very very small number of countries. To my knowledge NONE of them are countries where families are also sent to. So, in short, no, according to regulations, there should be NO requirement for you or your kids to have to get vaccines to move with your husband.

      IIRC, the only vaccine that may be required for entry pretty much anywhere is the Yellow Fever vaccine and that’s only if you’re travelling from or to certain South American and African countries. Otherwise, there are *NO* required vaccines for travelers, and, therefor, are *NO* required vaccines for military family members travelling to other places.

    1. You’re right, it is 3-5. I have it as 3-5 in the section talking about the actual regulation, but I have it wrong in the portion where it is quoted in the ‘reason’ section for the exemption form. I’m also going to change that section a little bit to remove the second section referring to the Army only regulation. Thank you!

      As for them already having had some vaccines – My kids had both had some vaccines when we went through this process. No one ever asked me if they had some so I just treated it as if they’d never had any.

      That became an issue one time in the ER when they wanted to give my (at the time) 8-year-old a tetanus booster. I had said that we don’t vaccinate, BUT, he was actually current on his tetanus vaccine since he had had all of the series before we stopped. If he had been 10 or older, then, yes, according to the schedule he may have needed a booster.

      I’m not big on lying for any reason and in other posts here I lump in omission as lying, but the point is simply that your child is not up-to-date according to the CDC (as in Centers for Disease Control, not Child Development Center) schedule and you are therefor requesting an exemption. That is 100% true whether they are missing one dose or all of them, if that helps 😉

Hi my SO is AD Army and my good friend pointed me in this direction so I could find Loop and get informative information on how to not vaccinate my children or myself as long as he remains active duty and we are having to go through on post care, schools, etc. I’ve been having a hard time finding consistent information saying that I do have the right to say no and it won’t affect us being removed from Tricare I am currently pregnant and I do not want to have this baby on post and fear that they can override my wishes.
    I would love to speak to a few other moms who had their babies on post and we’re successfully able to have the birth plan they chose.

    1. If you want to have your baby off post, you most certainly can, it just may not be covered if you’re Tricare Prime. On Standard you would choose your own doctor / facility off base.

      For the schools, schools on post in the US are still generally part of the local public school system so they follow the local state’s regulations. ie, California only allows medical exemptions, but Utah follows medical, religious, and personal belief / philosophical exemptions.

      For daycare on post, they are supposed to follow the regulation cited meaning that they allow medical and religious.

  38. My hubby is active AF. We currently live in my home state where vaccinations are not an issue at all. I was never vaccinated and my kids havnt either. My biggest concern is going to other states where they are jerks about it. As active duty dependants do we fall under our home state laws, federal laws, or the state we are stationed in? Im so worried, and i cant find information anywhere!

    1. The short version: Moving between states shouldn’t be affected by vaccines. As for regulations / laws, it will be your new state’s regulations that apply for schools and daycare, unless you use on-base childcare. There are NO federal regulations regarding vaccination.

      PCSing to a different state there shouldn’t be any issues with the actual PCS process. The only time there should be any issues within the continental US is for schooling. Even if they go to school on base, those are still usually public state schools under the local state school district and therefor fall under the individual STATE’s regulations for vaccinations. California, Mississippi, and West Virginia are currently the only states that ONLY allow medical exemptions for school and daycare. However, on base daycare goes by the regulation cited.

      For example, if you live in Idaho and are moving to Utah, the move shouldn’t be affected at all. In Utah, the kids would be under Utah’s regulations (which are easy as they use all three – medical, religious, and personal belief) for schooling if they go to the base school, or if you live off base. If they go to the daycare on base, then it’s the medical and religious exemptions. Daycare off base, it’s the same regulations as for schooling which are all three – medical, religious, or personal belief.

      Basically:
      On base schools in the US are local school districts and so follow the STATE regulation so it varies. (http://www.nvic.org/vaccine-laws/state-vaccine-requirements.aspx)
      On base daycare follows the military regulation and so ALWAYS should allow medical and religious.
      Off base daycares follow the STATE regulation so it varies. (http://www.nvic.org/vaccine-laws/state-vaccine-requirements.aspx)

      Going overseas is a whole other thing, however, in short, your vaccine status should never matter for PCSing there either. The only time vaccines affect PCSing overseas, according to regulations, is if the country requires vaccinations for travelers. Those countries are few and far between. Basically, they’re the few countries that require Yellow Fever vaccination because it’s rampant either where you came from, or where you’re going to, and none of those countries are places where they send families. It should only really affect schools and daycare. Just for information, though, DoDEA schools (overseas schools on base) follow the same military regulation as on base daycares and so should allow medical and religious.

      I hope I didn’t overwhelm you with to much information, lol.

  39. Thank you for sharing all your research with us. I need your input. My husband (NAVY), has orders for Japan. We are having a hard time with the immunization office-nurse. They are saying we HAVE to have our children up to date on their immunizations before they send us to Japan. They mentioned that if we don’t that the NAVY might send my husband without us :/. Not sure if this is true or just a scare tactic they are using for us to get them vaccinated. Thank you.

    1. All I can do is point you to the regulation. It covers ALL branches. The only section that may be applicable it trying to get people to vaccinate for overseas PCS is:

      3–6. Other populations
      a. Department of Defense and U.S. Coast Guard beneficiaries.
      (1)
      Family members of military personnel. Family members receive immunizations according to current ACIP recommendations. In addition, Family members may be subject to Service-specific requirements and recommendations for immunizations applicable to the country in which they will reside while accompanying military members under military sponsorship.

      The issue us that Japan doesn’t require any vaccinations. There are RECOMMENDED vaccinations when traveling. ACIP RECOMMENDS vaccinations, but doesn’t require them by law. Any religious objections should be honored.

      We PCSd as Air Force to Japan with no issues. I have heard of Navy having issues, but as both branches use the same exact regulation, I’m not sure why that is.

      I would ask for them to point you to the regulation that supersedes your federal right to refusal. However, there is no regulation that says that they have to send you with him either. You could try reminding them that you know of plenty of families that have PCSd without up-to-date immunizations.

      1. The joint reg can have further regulations, guidance or restrictions added to it for each branch. The regulation is probably the one where the military is paying for you to fly to another country. Past anecdotal incidents don’t carry weight.

      2. I understand the past anecdotal incidents don’t really matter, but what should be questioned is why certain families are being subjected to ‘regulations’ that other families are not. A regulation, by definition, is something that should apply to EVERYONE, except in very clearly defined incidences. Those exceptions should be somewhere in some other regulation, not just “oh, well we changed our minds” kind of things, and therefor should be able to be ‘pointed to’.

        Do you have a link to the regulation your talking about? The one about paying someone to fly to another country?

  40. Hi, I’m freaking out a bit. We just got orders to Italy and they JUST passed their mandatory vaccination laws last year. Since we’re military, does that apply to us? If so, what do I do? I’m in panic mode. Help, direction, something.

    1. The mandatory vaccinations are for school entry. They shouldn’t technically affect your ability to PCS there or for children to attend DoDEA schools or on base daycare since those still follow under the military regulations.

      1. Okay. All the sources I found had very broad language. They stated “School age children” not specifying whether it was only required for school attendance.   42. 10 years many PCS’s many different States/Posts, only had issue at one post in Hawaii, the health nurse for CYSS was vehemently opposed. One work around of the “Clergy/Chaplin” letter request is that I got Ordained as a Minister https://www.universalministries.com/ So my letter read: I _____ Ordained Minister, Religious Leader to and Parent/guardian of _____ …….
    I also reminded them that it was illegal for them to ask my religion. I did have one instance in a DODEA school when there was a vaccinated kid who got the chicken pox and they told me my kid had to stay home for 3 weeks for his safety because it was an “epidemic”. I just called the DODEA school Liaison and asked for the verification that the CDC had issued an “epidemic or possible epidemic outbreak” for the school. There was not one as only one case had been reported and I reminded them that if it was a vaccinated child that got it then all the children in the school were at risk and perhaps they should shut the whole school down for 3 weeks for the safety of everyone. They immediately reinstated my child. State side DODEA and CYSS go by the requirements of what ever state the post is in. So the first thing I do is get the exemption through that state, then I present it to the various places on post.

We are being told we will all need Japanese Encephalitis vaccine at the very least. Like you mentioned earlier, Japan has no required vaccines for entry. I’m just having trouble finding documentation stating our rights as dependents. Also, do you know of a form I can fill out for exemption status for PCS (similar to the one for DoDEA? Thank you again!!

    1. I really don’t know about the JE vaccine. When we PCSd, none of us were required to get it, even my husband IIRC.
      When it came to any exemptions for PCSing, it was mentioned during the kids’ physicals that they weren’t up-to-date, but their pediatrician was really nice about it. It just wasn’t a big deal. It didn’t even come up during our med board meeting.
      You could try writing a letter, or you could try using the DoDEA form. It could show precedent for exemptions. ie, that exemptions are allowed in the military for dependents for certain activities and that there is an official form for those times.

    1. This process really only applies to on base child care. If you’re planning on using the on base daycare center, I’d go ahead and fill out the form and bring it in when you sign up at the CDC on base. If you’re planning on still using off base child care, then you go by the individual state’s regulations.

      Same for any schools. Unless you’re overseas, schools follow the local school district / state’s regulations. Only overseas schools follow the DoDEA form.

      So:
      On base daycare – fill out the exemption and bring it when you sign up at the CDC on base ASAP in case they give you push back.
      Off base daycare, on base school, off base school – check the regulations for your state.
      Overseas school – Use the same form as it’s a DoDEA school.

      1. Are the on base Primary Care providers willing to accept the Religious Exemption? We have only used off base civilian providers. I am nervous since we are PCSing to a base on post and I don’t want the Army hospital or clinic to force us to vaccinate. We did vaccinate in all previous years before learning more about vaccines. I no longer want to vaccinate and we are homeschooling. I am concerned about the PCM or army medical providers giving us a hard time for no longer wanting to vaccinate. Can the Army hospitals refuse medical care if you no longer want to vaccinate? I have a child on the EFMP program. Please advise. Thanks so much.

      2. People get confused about exemptions a lot. The only reason an exemption is needed is because there are regulations that otherwise state that vaccinations are needed, like in schools and daycare centers. There are no regulations stating that people must be vaccinated to be seen at a Military Treatment Facility. Even if there was, your religious exemption for schools and daycares wouldn’t necessarily apply as that exemption is specific to schools and daycare centers.

        That being said, some people have issues with on base doctors, some don’t. We have never had an issue at any of the 3 bases we have been at since we stopped vaccinating.

        You can tell them that you don’t vaccinate for religious reasons when they bring them up, but, again, the exemption form you have doesn’t really apply.

  46. Hi there, I did not see anyone mention Ramstein Germany. Have you heard of anyone having a hard time PSCing there? We will be homeschooled and see medical off base for my son (2yr) and I and child care will not be an issue. Just wondering about the PSCing part.

    1. Everything I’m seeing says that people have had not problems with PCSing. Some were told they needed vaccines and they just said “no” and were able to PCS without any other issues really.

  49. Does this apply for going international? For example if my husband gets stationed in Italy does this exempt myself and my daughter from being immunized? Also does it exempt my husband or is it different because he is the one serving?

    1. We have PCSd internationally without having to have myself or the kids be “up-to-date” with no issues. As for the Active Duty member, there are exemptions available for them, but it’s a tricky thing as it can then make them non-deployable and less likely to be able to reenlist without a legal fight.

They are one of the biggest reasons our societies child mortality has gone down and life expectancy has gone up. Your “vaccine choice” movement is incredibly misguided to the point that it’s dangerous. You all are the reason archaic diseases are coming back.

    Navy wife with a 1 year old unvaccinated child and husband got orders to Sandiego California. With their new policy on vaccines and only accepting medical exemptions statewide, will this article apply to me? I want to be able to utilize the CDC there. I’ve been able to use the CDC while overseas just fine with no issues just want to be able to continue once stateside. Any information will be appreciated!!

      3. If it’s a military run CDC, they should follow the military CDC guidelines. As to a specific regulation that says they follow DoDEA and not state, there isn’t one, there’s just that the regulation cited is specifically for DoDEA CDC centers.

  51. We just got an assignment to NAVSTA Rota, Spain. I’m concerned that my non-vaccinated daughter and not up-to-date son (realization after the fact) are going to get held up and we all are going to end up missing the opportunity to live in this beautiful country. What are your tips to make this process as smooth as possible and have you heard of anyone getting refused orders simply due to vaccinations? Any and all information is greatly appreciated.

    1. My only tip is that to my knowledge there is no regulation that states that dependents must be vaccinated to PCS to this location or any location that families go. The only time vaccinations should be required (not recommended) is going to places that require them across the board like places that require Yellow Fever vaccination. If you are refused I would (nicely) as for the regulation that allows it.

    I’m a new mom, my son is 2 months old and I was pressured into the Vit K shot at birth, however I am declining every other shot. I am vegan and also believe vaccines are harmful.

    The military base we are at is overseas in England and we are getting pressured! The military nurse even told me my son wouldn’t be able to use the CDC or school which I know isn’t true! She even wrote along the lines on my child’s medical notes that I was “difficult”.

    Quick question, I see the DoD exemption form is for schools, which form is for the CDC? And who do you hand these forms to?

  53. This is just updated information that may be helpful to pass along. I am a DOD civilian dependant on an overseas army base in japan. While the DODEA exemption form was accepted without question for the elementary school the CDC and CYS is now saying they have a new rule that al children must have the flu vaccine to participate in sports or CDC/CYS activities. I will be printing off the helpful memorandum you created about the Supreme Court and our rights and if needed I will take this to the IG. I just wanted to pass along as forewarning to anyone else who may run in to this issue. To be determined how it turns out.

My husband is a DoD and we will be going to okinawa hour but before we except it I want to make sure that I am allowed to bring my unvaccinated children they are 9 and 11 I will not vaccinate one vaccine at all so I’m very strict so I need to make sure when we thought we were going to mainland Japan I called the school they are and they said they were fine but I’ve seen a lot of conflicting things for Okinawa.

    1. As far as I know, the basic forms haven’t changed. If they have, a good rule of thumb is just to re-look up the form number for any updated versions.

  56. Hello! I’m wondering if all on post physicians can decline care for my children. I have a 5 and 6 year old who are not vaccinated. We loved in Germany for the first 5 years of their lives and the on post doctor was really understanding. Now we are back in America and I feel nervous about our first well child visit. Can they refuse to see us after we tell them we don’t vaccinate? We are stationed on Fort Bragg specificially. Thanks again!

    1. So, we’re a few years post-Active Duty now, but up until my husband’s separation in 2017, we had no problems, either overseas or stateside with on base / on post physicians refusing to see our kids. Obviously, doctors change just like other personnel on base change, but we had no issues at Hill AFB or Hollomon AFB. Those are the only two I can specifically speak to though.
